1. Acceptance of Terms
Welcome to WinePath. By accessing or using our mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our app.
These Terms constitute a legally binding agreement between you and WinePath. We reserve the right to update these Terms at any time, and your continued use of the app constitutes acceptance of any changes.
2. Eligibility
You must be at least 21 years old (or 18 years old in jurisdictions where that is the legal drinking age) to use WinePath. By using the app, you represent and warrant that you meet this age requirement.
You must provide accurate, current, and complete information during registration and keep your account information updated.
3. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use of your account
- You may not transfer or share your account with others
- You may not create multiple accounts to evade bans or restrictions
4. Acceptable Use
4.1 You Agree To:
- Use the app only for lawful purposes
- Respect other users and their content
- Provide accurate information about wines and tastings
- Comply with all applicable local, state, national, and international laws
4.2 You Agree NOT To:
- Post false, misleading, or fraudulent content
- Harass, abuse, or harm other users
- Post spam, advertisements, or promotional content without permission
- Impersonate any person or entity
- Violate any intellectual property rights
- Attempt to hack, disrupt, or damage the app or servers
- Scrape, crawl, or collect user data without permission
- Promote illegal activities, including underage drinking
- Post offensive, discriminatory, or inappropriate content
- Use the app for any commercial purposes without our written consent
5. User Content
5.1 Your Content
You retain ownership of the content you create (tasting notes, photos, comments, etc.). By posting content on WinePath, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and improving the app.
5.2 Content Moderation
We reserve the right to remove any content that violates these Terms or is otherwise objectionable, without notice. We are not obligated to monitor user content but may do so at our discretion.
5.3 Copyright

6. Privacy
Your use of WinePath is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
7. Intellectual Property
WinePath and its content (excluding user content) are protected by copyright, trademark, and other intellectual property laws. The WinePath name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of WinePath.
You may not use our intellectual property without our prior written permission.
8. Third-Party Services
WinePath may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk.
9. Disclaimers
9.1 "As Is" Service
WinePath is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
9.2 No Medical or Professional Advice
WinePath is for informational and entertainment purposes only. We do not provide medical, health, or professional advice. Please drink responsibly.
9.3 User Content Disclaimer
We do not endorse, guarantee, or verify the accuracy of user-generated content. User opinions and ratings are their own and do not represent WinePath's views.
10. Limitation of Liability
To the fullest extent permitted by law, WinePath and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the app.
Our total liability to you for any claims arising from your use of the app shall not exceed the amount you paid us in the past twelve months (or $100 if you have not paid us).
11. Indemnification
You agree to indemnify, defend, and hold harmless WinePath and its affiliates from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from your use of the app, your violation of these Terms, or your violation of any rights of another.
12. Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Extended periods of inactivity
- Requests from law enforcement or government agencies
You may also delete your account at any time through the app settings. Upon termination, your right to use the app will immediately cease.
13. Dispute Resolution
13.1 Informal Resolution
If you have a dispute with us, please contact us first at support@winepath.app to attempt an informal resolution.
13.2 Arbitration
Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in a class action lawsuit or class-wide arbitration.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions.
